Dedicated Server Service Level Agreement
What We Guarantee
  1. 99.99% Uptime (applied per host)

    This DSSLA item will be calculated as follows:
    ((Downtime_In_Hours) - (0.01_Percent_Of_Hours_In_Month)) * (Monthly_Rate) * 1.5 / (Hours_In_Month)

    Downtime is defined as the time required to restore services from failure, starting 5 minutes after notification is received.

  2. 30 Minute Reboot Response (applied per host)

    This DSSLA item we be calculated as follows:
    (Extra_Reboot_Time_In_Hours) * (Monthly_Rate) * 1.5 / (Hours_In_Month)

    Reboot Time is defined as the time required to reboot the server from the time the request is submitted through the WebOnce Technologies website interface.

  3. 4 Hour Client Care Request Response Time (applied per client)

    This DSSLA item will be calculated as follows:
    (Request_Response_Delay_In_Hours) * (Monthly_Rate) * 1.5 / (Hours_In_Month)

    Response Time is defined as the time required for WebOnce Technologies to respond to a request submitted to our Private Servers request team.

In the event WebOnce Technologies could not meet one or more of the guaranteed items above, the guaranteed item which provides the largest refund will be applied. At no time, under any condition, will a refund exceed 50% of the Monthly Rate, under any circumstance.

Definition of Failure
  1. No dialup or broadband visitor can make any connection to the server (including but not limited to HTTP, FTP, PING) for over 5 minutes.
  2. There is no Internet originating traffic reaching the server.

In the case of there being no service failure under this definition, and action was requested by the client, time spent as a result of that request shall be considered maintenance work. Maintenance work which goes over the client's maintenance package is billable at the rate of $60 (Sixty United States Dollars) an hour, in 15 (fifteen) minute increments (at the rate of $15 (fifteen United States Dollars) per 15 (fifteen) minute interval).

Limitations under this Agreement

The following list defines events that are NOT considered as part of a Failure to achieve our previously outlined guarantees, and will not result in counting toward any refund that may be applicable under this agreement:

  1. A failure that is a result of any scheduled, or planned, service, or maintenance, of any of WebOnce Technologies, or the providers WebOnce Technologies relies on to render it's services.
  2. A failure of the Client's ISP or LAN.
  3. Any failure as a result of a force of nature, or what is commonly considered as "acts of God."
  4. Any failure as a result of a third party (including but not limited to: poorly designed scripts, denial of service attacks, joe jobs, and service exploitation.)
  5. Failure of third party software to maintain proper quality control, including but not limited to: web applications, web scripts, and control panels.
  6. Any failure as a result of misuse of the server, including but not limited to: overloading the processor, resource mismanagement, and any action that breaks our Acceptable Use Policy.

WebOnce Technologies will not be liable for compensation in any form of any losses or damages of the client caused by any failure to render any service for any reason.

Method of Refund

In the event the client has maintained a current account with WebOnce Technologies, refunds will be applied as credit to that account, and will be automatically applied to any further invoices, until such a time as the value of the credit has been exhausted. If the client no longer maintains a current account, the refund will first be applied to any outstanding balance remaining with the client, and then the remainder will be returned either by a payment sent through PayPal, or by mailed check to the client, at WebOnce Technologies sole discretion.

Amendments

WebOnce Technologies reserves the right to ammend or modify the terms of this agreement at any time, providing that WebOnce Technologies provides written notice on both the WebOnce Technologies Web Site (www.webonce.com) and within the contents of this agreement. Any such modifications to the agreement will be listed below, with both the date, and a detailed description of the modifications.
